Get Your Required Workplace Violence Prevention Plan In Place

California employers must implement Workplace Violence Prevention Plans (WVPP) by July 1st!

Why is a WVPP Necessary?

In 2021, 57 people died in workplace violence in California. Nationally, there were 392 workplace violence deaths in the US in 2020. Additionally, from 2015 to 2019 in the US, there were 1.3 M nonfatal workplace violent crimes. According to OSHA, workplace violence is the 2nd leading cause of fatal workplace injuries.

What Are The Requirements for a WVPP?

Senate Bill 553 requires Workplace Prevention Plans designed to identify, prevent, and address incidents of workplace violence. The plans must be tailored to each location’s specific needs and circumstances, reflecting the unique risks and dynamics of the workplace.

Virtually all California employers must:
  • Develop, implement, and maintain a comprehensive plan to prevent workplace violence.
  • Conduct a thorough assessment to identify potential workplace violence hazards within your operations.
  • Examine incidents of workplace violence (broadly defined) and compile detailed investigation reports.
  • Maintain detailed logs of violent incidents and threats.
  • Deliver interactive training sessions for all employees as required.
  • Retain and make available, upon request, records related to the workplace violence prevention program, adhering to specific retention periods.
Penalties for Non-Compliance

As with all new laws, strict guidelines must be followed to avoid penalties for non-compliance. Issuance of a citation by OSHA, which may include civil penalties up to the following maximums for citations issued on or after July 1, 2024:

  • $15,873 for General and Regulatory violations, including posting and recordkeeping violations.
  • $158,727 for Willful and Repeat violations (the minimum penalty is $11,337)
  • $ 25,000 for Serious violations
